Case of Rabbi Yaakov Yitzhak Rata

Case of Rabbi Yaakov Yitzhak Rata
(AKA: Yaakov Yitzchak Rata)

Maasiyahu Prison - Israel
Beitar Illit, Israel
Shomrei Emunim Rebbe of Mea ShearimJerusalem, Israel

Rabbi Yaakov Yitzhak Rata, who was convicted on charges of both rape and incest back in 1997.  At the time he was sentenced to 16 years in prison.  Upon his release from jail he inherited the title "rebbe" from his father.  Passing the title of "rebbe" on to the children of deceased highly respected rabbis is a tradition very common amongst chasidic Jews.  It's very similar to passing the title of King down to offspring of royalty.

The father of the convicted sex offending rabbi was Rabbi Avraham Chaim Rata, who was known as the "Shomrei Emumim Rebbe" died last summer. He led a small congregation of 200 followers based in Jerusalem, Israel.

Yaakov Yitzhak, who is in his 50s, has come out of prison straight into the leadership of one of the Shomeri Emumim communities scattered across the country.

VCA 5000/97 Roth Jacob v. State of Israel.

At the Supreme Court

VCA 5000/97 - B

Before: The Honorable Judge. Front

Appellant: Jacob Roth

Against

Respondent: State of Israel

Appealed the District Court's decision
Tel - Aviv - Jaffa from 6/17/97
WC 1084/97 given by the Honorable Judge
Beizer and resolution dated 13/08/97
WC 1382/97 given by the Honorable Judge
A. Vitality

Date of Hearing: In August Tsn"z (04/09/97)

Behalf of the appellant: Adv Lidsky, Attorney Danny Rose

For the Respondent: Michal Gal

Decision

One. Against the appellant filed with the District Court in Tel - Aviv - Jaffa charges (T.f. 3048/97), which are attributed to him counts of child abuse, domestic sexual offenses (rape and sodomy) forced indecent assault, sexual assault of a minor, indecent assault minor family members and impeachment investigation.

According to the indictment said the offenses were for ten years, at the appellant's brother, since she was eight years old. During this period, the complainant was given the responsibility of the appellant.

With the indictment, appellant was asked to hold a remand, and the court, after examining the evidence - and gave his opinion that Appellant was arrested on his way to the U.S. to escape justice - granted the request and ordered accordingly.

Against this decision, appellant's counsel filed a request for reconsideration (BS 1382/97), when the base application is the fact that the complainant had testified and therefore no room for fear arousal, if released, would take steps to influence change testimony.

Appellant's counsel suggested that the appellant be released to house arrest Apartment for hosting "made available by the Feldman family seat flourish, Mr. Feldman and his son committed to closely monitoring the actions of the appellant.

The request for reconsideration was denied, as the basis of rejection are, after all, two reasons: first - because there has been no change regarding fear arousal escaped from the country, as determined by the judge who had sentenced the original request, and secondly - the fear of the impact on the complainant has not expired, even though Testimony has been heard.

Two. Appeal directed against the reasons that motivated the court to order the detention of the appellant until the end of proceedings to begin, and for the reasons given for rejecting the request for reconsideration.

Against the original decision, the appellant's counsel argues that the court was wrong in that: not found undermine the credibility of the basis of the complainant's testimony that she had motive - According to the appellant - libel slander him, unaware that, in court testimony passes the complainant was given the option to review the opinion Dr. Hiss, set about his findings following examination of her hymen, and did not accept the appellant's explanation about L"bhilot "trip overseas and ruled that the trip was intended to evade the law.

Against the motion for reconsideration of appellant's counsel claims: that the court erred believed, fear of the effect on the complainant is repulsive powerful alternative to detention, even though the plaintiff had already testified and that the clock can be guaranteed not evade the law under restrictive conditions are suitable.

Appellant's counsel's view can promote the faces of all the risks underlying the arrest of supervised house arrest were sent, and the granting of an exit ban lender depositing passport.

3. The nature of the offenses attributed to the appellant - which we could spread extensively testimony already said complainant - Founder duty of the appellant strong of fact, if released on bail will make every effort to escape the country and to influence the complainant to return to her testimony she gave, and restrictive conditions, including those proposed by Counsel for the appellant, do not establish a reasonable basis to view, that might have the power to prevent the risk of double-sided question.

The facts underlying the fear of escape from the earth, fixed the attempt had to leave the country urgency, on learning stir up the existence of the police investigation against him, and the fear of the impact on the prime witness - the complainant - anchored the efforts made by the entire family to dissuade the complainant from providing evidence of police and then in court. Other risks described above, evidence, and under the circumstances, there is no reproach to the honorable judges discussed this matter so far, the thought that the only way to meet them is - holding appellant in custody.

4. I did not miss the special hardships that the arrest of the appellant, given the way he lived. However, this does not justify taking the risks that were taken while the water was a different way of life.

In light of the above, the appeal was rejected.

Given day in August Tsn"z (09/04/97).

Sex offender becomes rebbe
By Kobi Nahshoni
YNET - March 18, 2013

Yaakov Yitzhak Rata, who was sentenced to 16 years in prison for rape, released from jail and immediately inherits new position from his father, who died during his imprisonment

Ex-convicts are usually sent to post-imprisonment rehabilitation programs, but in Israel such a person has immediately attained a high position – without any cooling-off period.

Yaakov Yitzhak Rata, who was convicted of rape and sentenced to 16 years at the Maasiyahu Prison's religious wing, was released from jail last week only to become a rebbe – a position he inherited from his father, who died during his imprisonment.

The ultra-Orthodox public is now divided over whether he will gain any followers.

The father of the rapist rabbi was Rabbi Avraham Chaim Rata, who was known as the "Shomrei Emumim Rebbe" and died last summer. He led a small congregation of 200 followers based in Jerusalem.

In order to prevent any succession disputes, the rabbi wrote in his will that all his sons and sons-in-law would take his place in the congregation's leadership, each in a different concentration of followers. So now his son, ex-convict Yaakov Yitzhak, who is in his 50s, has come out of prison straight into the leadership of one of the Shomeri Emumim communities scattered across the country.

Missed opportunity to gain followers?

Haredi website Kikar Hashabat reported about "great joy in the Hasidic movement" when "the righteous rabbi, Yaakov Yitzhak Rata, was released from a 16-year imprisonment."

The report added that Rata was expected to serve as a rebbe in the haredi city of Beitar Illit, where the leader of the Shomrei Emunin community had yet to be appointed.

"The rabbi denied the offenses attributed to him and refused to confess to the acts, and as a result even avoided signing a plea bargain, which worsened his legal situation," reporter Israel Cohen explained in his merciful report. "His father, the Rebbe of blessed memory, had expressed his silent support for him too and believed that he was innocent."

Talking to Ynet, Cohen said it was unclear whether the released sex offender would turn into a real spiritual leader.

"On the one hand, he and his brothers are not the type of figures that attract believers like the Rebbe was, and he specifically was in jail when the father's followers were divided between the sons and missed the opportunity to gain some of them. On the other hand, it's possible that because of his story some will see him as a martyr persecuted by the authorities and follow him."

'Inconceivable'

Ex-convicts who served with Rata in prison were surprised to learn about the position waiting for him outside.

"How can it be that a person who served a prison sentence for sex offenses is now appointed as a rebbe?" one of them wondered. "It's amazing to discover how cheap this job can be."

The former inmates said that Rata did not maintain good behavior while in prison. "Many prisoners did not like him because he was aggressive toward his friends," one of them said.

"How can a community of religious believers follow a person who was convicted of serious offenses which put him to shame?" asked another former prisoner. "It's inconceivable that he will now become a rebbe."
